Dallas appeals court upholds drunk driving conviction

In Dallas, driving under the influence of alcohol or drugs can bring serious repercussions. A man is discovering just how serious after being found guilty of intoxication manslaughter stemming from a drunk driving accident in 2009 on I-20. The accident occurred east of Terrell after the man lost consciousness while driving. His truck veered out of his lane, striking another car head on. Two people were killed, and it was later established that the man's blood alcohol level was over twice the legal limit.

He was later convicted of two counts of intoxication manslaughter, sentenced to 40 years' incarceration and fined $20,000. The man appealed the drunk driving conviction, claiming that the blood test was improperly administered by an unqualified technician, his attorney was not allowed to question the jurors about sentencing, and that the accident was not caused by his driving under the influence. Though his attorneys have kept fighting on behalf of their client, the 5th District Court of Appeals in Dallas upheld his conviction on Feb. 10, affirming the trial court's judgment concerning the issues that were appealed.

Dallas man nabbed for child pornography on misplaced cellphone

A Dallas man who unwittingly left his cellphone on a gas pump is facing serious legal trouble. The 32-year old man must confront federal child pornography possession charges after his cellphone was found by a woman at the Shell station on Interstate 35E on New Year's Day. Approximately an hour after the woman found the cellphone, it rang and the accused man offered her $250 to return it.

The phone contained a pass code, preventing the woman from accessing the phone. After the man contacted her, he gave the woman the code so she could call him to set up a meeting to return it. Suspicious about the reward offer, the woman looked through the phone contents and discovered explicit images. She then turned the phone over to Lancaster police, who called federal authorities.

Guilty plea in Dallas child pornography case

A Dallas man is facing serious legal trouble after he pleaded guilty to a charge of child pornography in federal court on Jan. 27. A news release from the U.S. Attorney's Office stated that the man admitted he had images and videos of underage children on his laptop. The computer that contained the child pornography was found when FBI agents executed a search warrant in March of last year.

The Dallas man has acknowledged sharing images of child pornography via the Internet and through file-sharing software. The man pleaded guilty to one count of transporting and shipping child pornography. He is confronting significant prison time, ranging from five to 20 years, and also the possibility of fines of up to $250,000. He also faces the possibility of parole for the rest of his life. Sentencing is scheduled for May 4.

Man accused of violent crimes in Dallas area arrested

A missing family from Fannin County, approximately 60 miles northwest of Dallas, is presumed dead, and one of their relatives has been accused of their murder. The 52-year-old man was arrested in Louisiana after Texas Rangers and Fannin County deputies obtained a search warrant. Authorities seized the man's truck and trailer, suspecting that the bodies of the missing family members were located inside. They have not released information about what was found in either.

Neighbors said the family's daughter had moved into the ranch home to take care of her elderly parents a few years ago. Although only limited information about the victims was released, local news reports said the father is a diabetic and double amputee. How the accused is related to the alleged victims has not as yet been disclosed by authorities.

Insanity plea dropped in Texas sexual assault and torture case

An insanity defense has been nixed for a Navarro County man accused of torturing his former Texas neighbor. The man allegedly abducted the woman from her Parker County home in March 2011. He purportedly took the woman to his residence in Corsicana, approximately 100 miles from the site of the claimed abduction. Accused of using a deer-skinning device to torture the woman, he was arrested 12 days later at his Corsicana home.

He has been charged with aggravated sexual assault and aggravated kidnapping. If convicted of these crimes, the accused individual could receive a sentence of life in prison. Defense attorneys have told the judge that the man will not use an insanity defense, acknowledging that he is competent to stand trial for the alleged offenses. The judge has also ruled that statements made by the man to law enforcement following his arrest may be used as evidence during the trial.

DNA evidence frees man wrongfully convicted of rape

Sex crimes are never a frivolous matter. Trials for these crimes are a difficult experience for everyone involved, especially when the accused knows he or she is innocent. This is what happened to a Dallas man accused of rape committed against multiple young women and girls nearly two decades ago. It wasn't until recently that the man was cleared of committing these crimes with DNA evidence.

During the 1980s and 1990s, the "North Dallas Rapist," as he was dubbed, committed several sexual offenses. The wrongly convicted man was thought to be responsible for these crimes, so he was apprehended, convicted and imprisoned until his exoneration in 2010.

The U.S. Drug Enforcement Administration spent two and a half years investigating numerous people for a possible connection to a Mexican drug cartel. Recently, two individuals were indicted on drug charges after a facility located in North Tyler, Texas, was found to be housing drug-related activity.

Documents from the DEA allege that significant amounts of methamphetamine were cleaned at the Tyler facility before being transported for sale in Dallas. DEA agents searched the property and found empty alcohol and fingernail polish bottles, which are used in the meth cleaning process. Authorities say they also discovered cocaine and weapons on the premises.

This story has caused some to wonder if the winter holiday season has some sort of negative impact on peoples' emotions, causing them to commit violent acts.

Former Texas police officer sentenced to 70 months for child porn

Texas authorities take sex crimes very seriously. They are prosecuted aggressively in court and lead to harsh penalties, including prison time in some cases. One former Texas police officer recently found out just how harsh the Texas justice system can be on those convicted of a sex crime.

The former police officer was sentenced to 70 months, or five years and 10 months, in prison after pleading guilty to just one count of receiving child pornography. His incarceration will begin on Jan. 26. After serving his sentence, he will undergo a decade of supervised release.

After eighth DWI, Dallas man sentenced to 55 years

It's no secret that Texas law enforcement officers take a "tough on crime" approach to their jobs. As you may have gathered from other posts we've written, they make no exception for drunk driving. While a first-time drunk driving conviction may have lesser consequences, a third DUI charge -- any subsequent charges -- is considered a felony in Texas and comes with stiffer penalties. One Dallas man learned this recently after being convicted of his eighth DUI.

The 54-year-old man was arrested nearly a year ago after a witness called 911 to report a vehicle that was driving erratically. He was pulled over by police around 4:45 in the afternoon. As he was being questioned by police, the district attorney's office says a beer can fell out of the vehicle. Officers allegedly discovered an open alcohol container in the car as well.
