Common Questions When Hiring a Dallas Criminal Defense Lawyer

Criminal Defense LawyerIt’s easy to find yourself imagining the worst case scenario when you’re accused of a crime and navigating an unfamiliar criminal justice system can make the experience even more frightening. In fact, inaccurate assumptions and uncertainty can be the source of significant stress.

At the Law Offices of Jeffrey C. Grass, we make it a point to ensure that our clients know what to expect when it comes to the legal process and the potential penalties. Here are some of the most common questions that we explore with our clients.

What’s the Difference Between a Misdemeanor and a Felony?

Misdemeanor offenses encompass more minor crimes, whereas more serious offenses are charged as felonies. In Texas, there are a few different sub-categories, which are as follows (from least serious to most severe):

  • Class C Misdemeanor;
  • Class B Misdemeanor;
  • Class A Misdemeanor;
  • State Jail Felony;
  • Third Degree Felony;
  • Second Degree Felony; and
  • First Degree Felony.

The seriousness of a crime can be upgraded in certain circumstances. For example, if a crime involves aggravating factors, a street gang or if the defendant has a prior conviction for a particular crime, then the charge may be upgraded in terms of its seriousness. The more serious the classification, the harsher the penalty.

Will My Criminal Case Be Tried in State Court or Federal Court?

A large portion of criminal cases are tried at the state level, but there are some circumstances where a case could be pursued at the federal level. Federal crimes include:

  • internet crimes, such as internet sex crimes and fraud;
  • drug trafficking crimes;
  • immigration-related crimes;
  • crimes involving a federal agency, like the IRS or immigration;
  • crimes where the suspect and victim are in different states;
  • money counterfeiting and some forgery crimes;
  • criminal acts that cross state lines and therefore involve multiple states; or
  • large-scale crimes involving many victims or a massive criminal operation.

If a crime is a violation of both state law and federal law, the state prosecutor does typically have the option to refer the case to a federal prosecutor. This may be done in cases that can benefit from the broader range of resources that are available at the federal level. This may also occur in cases where there are multiple jurisdictions involved.

Federal crimes do tend to carry a harsher penalty, so it’s especially important that you have an experienced criminal defense attorney representing your case.

What if a ‘Not Guilty’ Verdict is Unlikely?

There are some cases where a “not guilty” verdict is highly unlikely due to overwhelming evidence. Even in these cases, you can benefit from working with an experienced defense attorney, who can maximize your chances at seeing a favorable case outcome.

It’s also important to note that a “not guilty” verdict is not the only favorable case outcome. In some cases, your lawyer can make a compelling argument for the dismissal of some or all of the charges against you, particularly if authorities failed to follow the appropriate procedures.

In other cases, your attorney can negotiate for a reduction in the severity of charges. If you are opting to forego trial due to overwhelming evidence, your lawyer can negotiate a plea bargain to minimize the charges and/or minimize any penalty that you may face.

There are many options, and many cases can be resolved favorably without going to trial. Each case is unique, and a talented defense attorney can often secure a positive outcome that would be beyond the reach of a less experienced attorney. Attorney Grass has been successful in getting dismissals and “not guilty” verdicts for clients who didn’t think this was possible, so even if the evidence seems overwhelming and damning, a top criminal lawyer can find loopholes and develop defense strategies that will enable you to overcome the seemingly insurmountable.
