What is the Legal Definition of Indecent Exposure in Texas?
Texas law indicates that indecent exposure involves the act of exposing one’s anus or genitals with the intent to arouse the sexual desire of any person. Additionally, this act typically includes an element of recklessness in that the suspect may be reckless about who is present (and the fact that they may be offended or alarmed) when the act of exposure occurs.
Notably, indecent exposure does not involve any touching or groping of another person. If this occurs, the incident is typically considered sexual assault.
What Actions Are Considered Indecent Exposure in Collin County?
In Texas, indecent exposure can include a number of different actions, including, but not limited to:
Public exposure of the buttocks or anus (also known as mooning);
Public exposure of any part of the genitals (also known as flashing); and
Public exposure of a woman’s breasts, with the exception of a mother who is breastfeeding.
Texas law regards indecent exposure as a sexual offense and although it’s a misdemeanor charge, the fact that this is considered a sex offense can cause serious problems in terms of employment, renting property or even attending a college or university.
What is the Penalty for an Indecent Exposure Conviction in Collin County?
Indecent exposure is typically charged as a class B misdemeanor.
If convicted of indecent exposure in Texas, you could face a maximum penalty of 180 days in county jail and/or a fine of up to $2,000.
